Welcome to Bookistics. These Terms & Conditions (“Terms”) govern your use of bookistics.com and any booking, reservation, package, or related travel service you purchase from Bookistics, Inc. (“Bookistics,” “we,” “us,” or “our”). By making a booking or using our site or services you agree to these Terms. If you do not agree, do not use our services.
1. Scope, Relationship to Suppliers, and Definitions
1.1 Scope. These Terms apply to all bookings and ancillary services offered on bookistics.com, including small-ship cruises, land tours, flight-inclusive packages, flight credits, shipboard credits, and other travel-related products (“Trips” or “Services”).
1.2 Supplier relationships. Many services are provided by third-party carriers, cruise lines, tour operators, hotels, and other suppliers (“Suppliers”). Unless explicitly stated otherwise, Bookistics acts as an agent or reseller for Suppliers and does not operate the transportation or accommodation services. Supplier terms, conditions, and rules apply in addition to these Terms.
1.3 Definitions. “You” and “Traveler” means the person(s) named on the booking. “Booking” or “Reservation” means an accepted request for travel services confirmed by Bookistics or a Supplier. “Price” means the total amount charged by Bookistics for the Booking, including fees, taxes, and any applied credits.
2. Booking, Confirmation & Documentation
2.1 How to book. Bookings may be made online, by phone, or by email. A booking is confirmed only when you receive a written confirmation from Bookistics or the Supplier and payment obligations have been satisfied per the payment schedule.
2.2 Accuracy of information. You are responsible for providing complete and accurate traveler names, passport details, ages, contact information, and any required health, visa, or special-service information. Errors or omissions can invalidate your Booking and may result in denial of transport or boarding.
2.3 Documentation. It is your responsibility to obtain and carry all required travel documents (passports, visas, health certificates, proof of vaccination, etc.). Bookistics will not be liable for delays, fines, or denied admission due to incorrect or missing documents.
3. Pricing, Payments & Fees
3.1 Prices. Quoted prices are in the currency shown at booking. Prices include those Supplier fees and taxes explicitly shown at checkout. Prices are based on current Supplier fares and availability and may change until your Booking is confirmed.
3.2 Payment schedule. Payment terms vary by Product and Supplier. Typical terms: deposit at time of booking (amount varies), balance due between 60–120 days prior to departure. Failure to pay by the due date may result in cancellation and forfeiture of deposit. Specific payment deadlines are stated in your confirmation.
3.3 Credit card & processing fees. We accept major credit cards and may apply card-processing or third-party payment fees where required.
3.4 Service fees. Bookistics may charge service/processing fees (administration fees, change fees) which are disclosed at or before booking. These fees are non-refundable unless otherwise specified.
4. Price Changes, Errors & Cancellations by Suppliers
4.1 Supplier changes. Suppliers may change itineraries, hotels, cabin assignments, fares, or availability. We will notify you when notified by the Supplier and attempt to provide alternatives. Suppliers’ changes are governed by Supplier terms and may entitle you to a refund or alternative; Bookistics is not responsible for Supplier decisions.
4.2 Price errors & typographical mistakes. If a fare or price is clearly erroneous (e.g., manifest error), Bookistics reserves the right to cancel the Booking and refund any amounts paid. We will not be liable for Supplier-imposed penalties resulting from your refusal to accept a corrected fare.
4.3 Supplier cancellations. If a Supplier cancels a Trip, any refund or re-accommodation is governed by Supplier rules. Bookistics will assist in processing refunds or alternatives but is not liable for Supplier decisions beyond facilitating communication.
5. Changes & Cancellations by You
5.1 Changes. Change requests (name changes, date changes, upgrades) are subject to Supplier rules and availability and may incur change fees from the Supplier and/or Bookistics. Any fare difference must be paid at the time of change.
5.2 Cancellations. Cancellations are subject to Supplier cancellation policies and any applicable Bookistics service fees. Where a Supplier’s policy permits refunds, refunds will be processed after Supplier funds are received and any applicable fees deducted. Timing for refunds is set by Suppliers and payment processors; Bookistics cannot control the refund timing.
5.3 No refund for unused services. No refunds are provided for unused portions of travel (missed flights, segments not used). Refunds for partially used itineraries are determined by the Supplier.
6. Flight Credits, Vouchers & Shipboard Credits
6.1 Nature of credits. Flight credits, vouchers, shipboard credits, or other promotional credits offered as part of a Booking are issued and governed by the relevant Supplier. Credits may be non-transferable, subject to expiration, and redeemable only under Supplier rules.
6.2 Redemption & expiration. It is your responsibility to redeem credits according to Supplier instructions. Bookistics will assist in applying credits at booking when possible but has no control over Supplier redemption policies, expirations, or restrictions.
6.3 No cash value. Unless expressly stated, credits have no cash value and cannot be exchanged for cash.
7. Travel Insurance & Protection
7.1 Strongly recommended. We strongly recommend you purchase comprehensive travel insurance that covers cancellation, medical expenses, evacuation, baggage loss, and Supplier insolvency. Insurance should be purchased promptly after booking.
7.2 Not provided by Bookistics. Travel insurance is not provided by Bookistics unless explicitly purchased as part of your Booking. Bookistics is not an insurer and does not provide insurance advice.
8. Health, Safety & Special Needs
8.1 Health requirements. You must comply with all health requirements imposed by Suppliers, ports, airlines, and governments (vaccinations, testing, quarantine). Failure to comply may result in denied boarding without refund.
8.2 Special needs. Advise Bookistics of mobility, dietary, or other special needs at booking. While we will attempt to assist, Bookistics cannot guarantee accommodation of special needs and is not liable for Suppliers’ failure to provide special services.
9. Conduct, Removal, and Liability for Misconduct
9.1 Conduct. Travelers must follow Supplier and Bookistics instructions. Disruptive, dangerous, or illegal behavior may result in removal from the Trip at travelers’ expense and without refund. Bookistics is not liable for costs arising from your misconduct.
9.2 Damages. You agree to compensate Bookistics and Suppliers for any damage, loss, or additional expense caused by your actions.
10. Force Majeure
10.1 Definition. Events beyond reasonable control (natural disasters, acts of God, war, terrorism, strikes, governmental action, pandemic, quarantine, port or airport closures, Supplier insolvency, and other unforeseeable events) constitute Force Majeure.
10.2 Effect. If a Force Majeure event affects a Booking, Bookistics and Suppliers may cancel, alter, or delay services. Refunds or alternatives are governed by Supplier policies. Bookistics will make commercially reasonable efforts to assist but is not liable for losses due to Force Majeure.
11. Limitation of Liability
11.1 Primary limit. TO THE MAXIMUM EXTENT PERMITTED BY LAW, BOOKISTICS’ TOTAL LIABILITY ARISING OUT OF OR RELATING TO THESE TERMS, YOUR USE OF THE SITE, OR YOUR BOOKING WILL BE LIMITED TO THE AMOUNT YOU PAID TO BOOKISTICS FOR THE AFFECTED BOOKING.
11.2 Exclusion of indirect damages. BOOKISTICS IS NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, LOSS OF REVENUE, EMOTIONAL DISTRESS, OR LOSS OF ENJOYMENT.
11.3 Supplier liability. Suppliers operate the services you book. Bookistics is not the carrier or supplier and is not responsible for Supplier acts or omissions. Remedies for Supplier failures are generally limited to Supplier terms.
12. Indemnification
You agree to indemnify, defend, and hold harmless Bookistics, its officers, directors, employees, agents, and affiliates from and against all claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising from (a) your breach of these Terms; (b) your negligent or willful acts; or (c) your failure to provide accurate information.
13. Intellectual Property
All content on bookistics.com (text, graphics, logos, images, and code) is owned or licensed by Bookistics and protected by copyright, trademark and other laws. You may not copy, reproduce, or create derivative works without our written permission.
14. Privacy & Data Protection
14.1 Privacy policy. Our Privacy Policy (available at bookistics.com/privacy) describes how we collect, use, and disclose personal data. By using our site and making a Booking you consent to the collection and use of personal information as described in the Privacy Policy.
14.2 Sharing with Suppliers. To fulfill your Booking, we must share traveler information with Suppliers and relevant authorities. By booking, you consent to such disclosures.
15. Third-Party Links & Content
Our site may contain links to third-party sites. Bookistics does not control third-party content, and links do not imply endorsement. We are not responsible for third-party practices or content.
16. Dispute Resolution, Governing Law & Venue
16.1 Governing law. These Terms are governed by the laws of the State of Florida without regard to its conflict-of-law provisions.
16.2 Venue. Except where prohibited by law, any dispute arising out of or relating to these Terms shall be brought exclusively in the state or federal courts located in Miami-Dade County, Florida, and you consent to personal jurisdiction there.
16.3 Costs. In any successful action to enforce these Terms, the prevailing party may be entitled to recover reasonable attorneys’ fees and costs.
17. Refunds, Credits & Timelines
17.1 Refund timing. Refunds are issued once a Supplier authorizes the refund and after any applicable Bookistics fees are deducted. Processing times vary and may take weeks depending on Supplier policies and payment processors.
17.2 Credits & vouchers. Where refunds are not practical, Suppliers may issue credits/vouchers. Such credits are subject to Supplier terms.
18. Assignment
You may not assign your Booking or these Terms without Bookistics’ prior written consent (name changes may be permitted subject to Supplier rules). Bookistics may assign rights and obligations to an affiliate or successor.
19. Electronic Communications, Notices & Agreement
19.1 Electronic communications. By providing an email address or phone number you agree Bookistics may communicate electronically (email, SMS, phone) regarding your Booking and service updates.
19.2 Notices. Legal notices to Bookistics should be sent to: Bookistics, Inc., 15896 SW 137th Ave, Miami, Florida 33177, USA (or the physical address shown on our site). Notices to you will be sent to the email on your Booking and are effective on dispatch.
20. Severability, Waiver & Entire Agreement
20.1 Severability. If any provision is held invalid, the remaining Terms remain in force.
20.2 Waiver. Our failure to enforce a right is not a waiver.
20.3 Entire agreement. These Terms, together with your Booking confirmation and our Privacy Policy, constitute the entire agreement between you and Bookistics regarding the subject matter.
21. Special Notices for Certain Products
21.1 Airline fares. Airline tickets are subject to carrier conditions; some tickets are non-refundable and non-changeable. Bookistics will attempt to apply any flight credits or bundled airline offers but cannot guarantee Supplier compliance.
21.2 Small-ship & expedition travel. Small-ship voyages, expedition itineraries, and remote-area travel often have restricted facilities and stricter safety protocols. You accept inherent risks associated with adventure travel.
22. Accessibility & Special Requests
We strive to make our website and services accessible. Notify us of accessibility needs at the time of booking. While we will assist, we cannot guarantee Supplier compliance or altered facilities.
23. Promotional Offers, Loyalty & Marketing
Promotional offers, discounts, and loyalty credits have specific terms (eligibility, blackout dates, expiration) disclosed with each promotion. Offers cannot be combined unless expressly allowed.
24. Changes to These Terms
We may update these Terms from time to time. Material changes will be posted on the site with an updated Effective Date. Continued use after posting constitutes acceptance of the updated Terms.

If you have a complaint about a Supplier, notify Bookistics immediately so we can assist. You may also have rights with the Supplier directly.
